Terms of Use

These Terms of Use ("Terms") govern your use of www.actionlabhealthcoaching.com (the "Site"), operated by Action Lab Health Coaching, LLC, a California limited liability company ("we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. What the Site Is

The Site gives general information about our mental fitness coaching (Positive Intelligence® / PQ®), health and wellness coaching, personal training, and nutrition coaching (together, the "Services"). Using the site does not create a coaching or client relationship. Services begin only after you and we agree in writing.

2. Not Medical or Mental Health Advice

Everything on the Site is for general education. It is not medical advice, mental health advice, diagnosis, treatment, or therapy, and it does not replace care from a licensed professional. Talk with your doctor before starting an exercise program or changing your diet, supplements, or medications. Never ignore or delay professional advice because of something you read on the Site and never change a medication because of our content. In an emergency, call 911. If you are in emotional crisis, call or text 988.

3. Scope of Services

Mental fitness coaching (Positive Intelligence® / PQ®) and health and wellness coaching: Coaching on habits, behavior, and mindset. This is not psychotherapy, counseling, or medical care.
Personal training: Exercise instruction, programming, and coaching.
Nutrition coaching: General, evidence-based information from public sources about nutrition strategies and supplements, so you can make your own decisions. We are not registered dieticians. We do not diagnose, treat, or prescribe meal plans for any condition.
Who provides them: Our owner and lead coach holds these active professional certifications:
- NBC-HWC (National Board-Certified Health and Wellness Coach)
- PQ® Coach (Positive Intelligence® Coach)
- PN2-MHC (Precision Nutrition Level 2 Master Health Coach)
- NASM Personal Trainer (National Academy of Sports Medicine Personal Trainer)
- NASM Certified Wellness Coach (National Academy of Sports Medicine Certified Wellness Coach)
- NASM Certified Nutrition Coach (National Academy of Sports Medicine Certified Nutrition Coach)
Referrals and safety: We may refer you to a licensed professional, and we may pause or decline Services if we believe they are not safe or appropriate for you.
No guarantees: We cannot promise any result.
Where we serve: Services are currently offered to clients located in California.

4. Please Do Not Send Health Information Through the Site

Do not put medical or other sensitive health information in our contact form or email it to us. After we agree to work together, we will send you secure forms for that purpose.

5. Your Agreement With Us

If you become a client, your signed coaching agreement and any waiver you sign governs the Services it covers. If it conflicts with these Terms, the agreement controls. These Terms cover only your use of the Site.

6. Positive Intelligence® Notices

The notice at the bottom of every page about Positive Intelligence, LLC, its trademarks, and our status as an independent coach applies to these Terms.

7. Intellectual Property

The Site and its content, including text, graphics, logos, forms, and handouts, belong to us or our licensors and are protected by copyright and trademark law. You may view and print the Site for your own personal, non-commercial use. Do not copy, modify, distribute, or use it for commercial purposes without our written permission. Third-party names, marks, and materials belong to their owners.

8. Testimonials

We do not currently post client testimonials. If we do, we will post them only with the client's written permission, and one person's experience is not a promise that you will have the same results.

9. Third-Party Links and Services

The Site links to or uses third-party tools, such as our website host, cookie-consent tool, and payment provider. We are not responsible for their content, privacy practices, or availability. Their own terms and privacy policies apply when you use them.

10. Using the Site

The Site is for adults 18 and older. Do not use it unlawfully, interfere with how it works, attempt to accept areas you are not authorized to use, scrape it with automated tools, or pretend to be someone else.

11. Disclaimers

To the fullest extent California law allows, the Site and its content are provided "as is" and "as available," without warranties of any kind. We do not promise the Site will be accurate, complete, uninterrupted, or error-free. Nothing in these Terms removes any right you have under California law that cannot be waived.

12. Limit of Liablility

To the fullest extent California law allows, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the Site, and our total liability for any claim arising from your use of the site is limited to the amount set by our attorney. this does not limit liability for fraud, willful injury, violation of law, or anything else California law does not allow us to limit, and it does not replace the terms of any waiver or coaching agreement you sign.

13. Governing Law and Where Disputes Are Heard

These Terms are governed by California law. Any dispute about your use of the Site will be heard exclusively in the state courts of Humboldt County, California, or the federal court for the district that includes Humboldt County, and you consent to those courts' jurisdiction, except where California law gives you the right to bring a claim somewhere else (such as small claims court in your county).

14. Accessibility

We want the Site to work for everyone. If you have trouble using any part of it, email sunny@actionlabhealthcoaching.com and we will help.

15. Changes, Severability, and Entire Agreement

We may update these Terms by posting a new version with a new effective date. Continuing to use the Site means you accept the update. If any part of these Terms is unenforceable, the rest remains in effect. These Terms and Privacy Policy are the whole agreement between you and us about use of the Site.
